Terms of service
§ 1 Scope
These Terms and Conditions ("Terms") apply to all contracts concluded between Andrew Koob, Résidence Club, Martin-Luther-Straße 7d, 97072 Würzburg, Germany ("Seller") and the customer ("Buyer") via the online shop at résidence-club.com.
A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 German Civil Code).
§ 2 Contracting party, conclusion of contract
The contract is concluded with Andrew Koob, Résidence Club. The presentation of products in the online shop is not a binding offer but a non-binding catalogue. By clicking the "Buy now" / "Shop" button in the final step of the order process, the Buyer submits a binding order for the items in the cart.
The confirmation of receipt of the order is sent automatically by email immediately after the order is placed. This confirmation does not constitute a contract. The contract is concluded when we send a shipping confirmation or hand the goods over.
§ 3 Contract language, storage of the contract text
Contracts can be concluded in English and German. The Seller stores the contract text. The order details are sent to the Buyer by email. After the order is placed, the order details are no longer accessible online for security reasons.
§ 4 Delivery
In addition to the stated product prices, shipping costs may apply. Shipping costs are shown in the offer and in the "Shipping & Delivery" policy. We only ship to the destinations listed there.
Pick-up in person is not possible. Delays caused by force majeure or unforeseen circumstances extend the delivery period by the duration of the obstacle.
§ 5 Prices and payment
All prices in the online shop are final prices in Euro (€). Under the small-business exemption pursuant to § 19 of the German VAT Act, no VAT is shown.
The Buyer can choose a payment method during checkout. Currently available: Shopify Payments (credit card, SEPA), PayPal, Klarna (Pay Now / Pay Later / instalments, subject to Klarna's credit check). Payments are due immediately upon contract conclusion.
§ 6 Retention of title
The goods remain the property of the Seller until full payment has been received.
§ 7 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. Conditions and consequences are set out in our separate withdrawal policy under "Returns".
§ 8 Warranty
Statutory warranty rights apply. For consumers, the limitation period for claims based on defects is two years from delivery. For used items, this period may be contractually shortened to one year.
§ 9 Liability
The Seller is liable without limitation for intent and gross negligence, and for damage to life, body, or health. In all other respects, liability is limited to foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.
§ 10 Online dispute resolution / consumer arbitration
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not participate in any such proceedings.
§ 11 Final provisions
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
